ABOUT THE JOB

The Director, Regulatory Compliance operates in a supporting role within the compliance department of a nationally operating company with a diverse service offering.

The individual occupying this position will assist with legal regulatory research and monitoring, policy review and preparation, enterprise risk management program, providing regulatory guidance and counsel to internal clients, and assisting with auditing & monitoring activities. This position manages, creates, implements, and administers various elements of the Marathon Health Compliance Program. Must be strong at legal research and drafting, able to create professional compliance documents, solutions-oriented, motivated, enthusiastic, dedicated hard worker with a good attitude.

The individual will provide advice on a range of healthcare compliance matters, including clinical practices, clinical forms, privacy matters, and business strategies. This role will require initiative and a desire to think outside the box in providing solutions and developing components of the compliance program that will best serve the company through an expected period of rapid growth and development. This role is perfect for a compliance attorney who enjoys variety and wants to have a big impact at a growing organization. This individual must be a self-starter with very strong writing and verbal communication skills.

ESSENTIAL DUTIES & RESPONSIBILITIES

Takes initiative and action to resolve compliance questions or concerns and the ability to further build out a successful and effective compliance program for the Marathon Health enterprise.

  • Training and Education
    • Creates new and innovative ways to communicate compliance policies to staff across the organization.
    • Develops content for and coordinates the compliance training program including updating the program as needed to address changes to the law, results of audits and investigations, results from previous training programs, trends in Compliance Hotline reports, and guidance from federal and state agencies.
    • Stays abreast of the latest developments, advancements, and trends in compliance.
    • Maintains an awareness of current laws, statutes, and regulations that impact healthcare operations.
    • Develops content for compliance training.
    • Monitors training and maintains compliance training records.
  • Reporting and Investigations
    • Investigates compliance and privacy-related matters which includes conducting interviews with clinical and non-clinical staff to gather facts.
    • Ensures timely reporting of patient privacy breaches to meet federal and state deadlines.
    • Documents findings and makes recommendations for corrective action plans based on investigation findings.
    • Maintains complete records of all investigations.
  • Monitoring Compliance Policies and Procedures
    • Create and develop compliance policies and procedures, clinical consent forms, and job aids.
    • Conducts annual reviews of enterprise policies and procedures, including patient privacy policies, to determine if revisions are necessary.
    • Chairs Company's Policy Review Committee on all enterprise policies and procedures.
    • Coordinates policy development and/or revisions with organizational leaders, when necessary.
  • Enterprise Risk Assessment and Monitoring
    • Supports complex, cross-functional projects including Enterprise Risk Management program and formulate risk management strategies, including optimal structure, and make recommendations to senior management.
    • Collaborate with other teammates on regulatory, compliance, and operational risks to provide feedback to directors at all levels to eliminate risks; assist clinical chairs and department heads in designing risk management programs within their departments.
  • Auditing and Monitoring
    • Identifies compliance risk areas that should be addressed by the Compliance Program.
    • Assists the Compliance Officer with the development of the annual Compliance Program audit plan.
    • Conducts compliance audits as assigned as well as ad hoc audits at the direction of the Compliance Officer.
    • Partners effectively with organizational leaders to monitor compliance risk areas.
  • Managing Compliance Records
    • Responsible for maintaining the Compliance Hotline database by ensuring all reports are investigated and resolved.
    • Maintains complete, accurate, and timely closure documentation of complaints from patients and staff including reports received through the Compliance Hotline.
    • Assists the Compliance Officer with preparing reports to the Compliance Committee, Governance Risk Committee, and Audit Committee of the Board of Directors.
    • May perform other duties as assigned.

QUALIFICATIONS

Juris Doctorate from an accredited law school with a strong academic record;healthcare regulatory experience

DESIRED ATTRIBUTES
  • 5+ years of experience advising in healthcare regulatory and relevant consumer protection laws
  • Demonstrated advanced knowledge of regulatory frameworks of HIPAA, GDPR, PCI, HITRUST, SOC 2 advising on information security requirements, incident preparedness, response, breach notification obligations, communications plans and remediation.

Pay Range: $130,000 - $180,000/yr

The actual offer may vary dependent upon geographic location and the candidate's years of experience and/or skill level. This position is also eligible for an annual incentive.
